SECTION 1 — WEBSITE, APP & BOOKING PLATFORM TERMS OF USE

These Terms of Use apply to your use of the Studio Align website, app and online booking platform. By accessing using these digital services, you agree to these Terms of Use.

2. Website, App and Booking Platform 

Our website, app, bookings, memberships and payments may be managed through third-party providers, including Mariana Tek and Stripe. 

We do not guarantee uninterrupted access to our website, app or booking platform. We may suspend, withdraw, restrict or update access where reasonably necessary for maintenance, security, operational, legal or business reasons. 

Our website is directed to people residing in the United Kingdom. We do not represent that content available on or through our website is appropriate for use in other locations. 

3. Acceptance of These Terms of Use 

By using our website, app, or booking platform, you confirm that you accept these Terms of Use and agree to comply with them. 

If you do not agree to them, you must not use our digital services. 

These Terms of Use should be read alongside our Privacy Policy. 

4. Eligibility and Account Registration 

You must ensure that all information you provide to us is accurate, complete and kept up to date. 

You are responsible for maintaining the confidentiality of your account details, password and login credentials, and for all activity carried out through your account. 

We reserve the right to suspend, restrict or terminate any account where we reasonably suspect misuse, fraud, abusive behaviour, repeated breach of these Terms of Use, or conduct that places our staff, instructors or clients at risk.

5. Intellectual Property 

We are the owner or licensee of all intellectual property rights in our website, branding, logos, graphics, videos, photography, written content and other materials. 

You may print or download extracts from our website for personal, non-commercial use only. 

You must not reproduce, copy, distribute, modify, republish, scrape or commercially exploit any part of our website or materials without our prior written permission. 

 6. Links to and from Our Site 

You may link to our home page provided you do so in a fair and lawful way that does not damage our reputation or suggest any association, approval or endorsement where none exists. 

You must not frame our site on another website or create a link to any page other than our home page without our prior written consent. 

Where our website contains links to third-party websites or resources, these are provided for information only. We do not control and are not responsible for their content, availability or privacy practices. 

7. Site Security and Acceptable Use 

We do not guarantee that our website will be secure or free from bugs or viruses. 

You are responsible for using your own virus protection software and ensuring your devices are suitably configured. 

You must not misuse our website by knowingly introducing viruses, trojans, worms, logic bombs or other malicious material, attempting unauthorised access, interfering with servers or databases, or carrying out denial-of-service attacks.

11. Governing Law and Jurisdiction 

These Terms of Use are governed by the laws of England and Wales. If you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you reside. If you are acting as a business, the courts of England and Wales have exclusive jurisdiction. 

SECTION 2 — STUDIO, CLASSES & MEMBERSHIP TERMS AND CONDITIONS

These Terms and Conditions (“Terms and Conditions”) apply to your use of the Studio Align studio premises, classes, memberships, class packs, and in‑person services. 

1. Studio Services 

Studio Align provides reformer Pilates classes and may offer other movement, wellness or community-based services from time to time. 

Our reformer classes are typically 50 minutes in duration. 

We reserve the right to update our timetable, instructors, class formats, class durations, pricing and services at any time. 

Classes, instructors and schedules are subject to change. 

2. Bookings 

Bookings must be made via our website or app unless otherwise stated. 

Booking windows are currently as follows:

• Class packs: up to 14 days in advance 

• Memberships: up to 21 days in advance 

A booking is only confirmed once it appears in your account or you receive confirmation from us. 

Walk-ins are not accepted unless expressly stated by Studio Align. 

All bookings are personal to you and may not be shared, transferred or resold unless we expressly agree otherwise. 

If a waitlist is offered through our booking platform, you are responsible for monitoring your account, email and app notifications. If you are added from the waitlist into a class, the usual cancellation policy will apply from that point. 

3. Arrival and Late Entry 

Clients should arrive at least 5 minutes before class. 

For safety reasons and to minimise disruption, we operate a strict 10-minute late policy. Entry will not be permitted more than 10 minutes after the class start time. 

Late entry is always at the instructor’s discretion and may be refused where it would not be safe or appropriate to join the session. 

If entry is refused due to lateness, this will be treated as a Late Cancellation, and your class credit will not be refunded. 

4. Cancellations and No-Shows 

To avoid losing a credit or incurring charges, cancellations must be made within the applicable notice period: 

• Class Packs: minimum 24 hours’ notice 

• Memberships: minimum 24 hours’ notice 

If you cancel outside of these notice periods:

Late Cancellation 

• you will lose your class credit 

• for membership holders, from the 3rd late cancellation in the same calendar month, a £15 fee will be charged for each further late cancellation 

No-Show 

• you will lose your class credit 

• a £15 no-show fee will be charged 

All applicable fees may be charged to the payment method saved to your account.  

Failure to pay any fees may result in suspension of your account and cancellation of future bookings. 

We reserve the right to amend our booking, cancellation and no-show windows from time to time, provided any such changes are communicated clearly in advance and do not affect rights already accrued. 

5. Memberships and Class Packs 

Memberships and class packs are personal to you and cannot be shared, transferred or resold. 

They must be used within their stated validity period. 

Recurring memberships will automatically renew unless cancelled in accordance with the cancellation terms presented at the time of purchase. 

We reserve the right to suspend or terminate memberships, class packs or booking privileges where our booking policies are repeatedly misused, including repeated late cancellations, no-shows, abuse of introductory offers, chargeback misuse, or conduct contrary to these Terms and Conditions. 

Any freeze, pause or exceptional extension of a membership or class pack will be entirely at our discretion unless expressly included within the membership terms at the point of purchase. 

We may terminate any membership on reasonable notice for business or operational reasons. 

6. Payments 

All prices are shown in GBP (£). 

By providing payment details and/or saving a payment method, you authorise Studio Align and its payment providers to charge you for purchases, memberships, recurring payments, any applicable late cancellation or no-show fees or for the reasonable cost of repair or replacement to any damage you cause to our equipment, facilities or property (other than fair wear and tear) automatically, without further notice. 

We may carry out standard pre-authorisation checks on your payment method. 

We reserve the right to update our pricing at any time. Any price changes will not affect purchases already made, although recurring memberships may be subject to change on notice. 

7. Refunds and Statutory Rights 

Payments are generally non-refundable except where required by law or where we cancel a class and do not offer a suitable alternative. 

If you purchase services online or at a distance, you may in some circumstances have statutory cancellation rights under consumer law. However, those rights may be limited or may not apply in full where the booking relates to a leisure service to be provided on a specific date or within a specific period. 

Where you ask us to begin providing services within any applicable cancellation period, you agree that any refund may be reduced to reflect the services already provided, where permitted by law. 

Nothing in these Terms and Conditions affects your statutory consumer rights. 

8. Studio Cancellations and Changes 

We may cancel, reschedule or alter classes, instructors, services or facilities where reasonably necessary, including for safety, illness, low attendance, equipment issues, maintenance or events outside our control. 

If we cancel a class, we will usually offer either: 

• the return of the class credit 

• transfer to another suitable class 

• a refund where no suitable alternative is available 

We are not responsible for associated costs you may incur, such as transport, parking, accommodation, childcare or loss of earnings, except where required by law. 

9. Health, Safety and Participation 

Your safety is important to us. You must complete any required health questionnaire or PAR-Q before attending class. 

You must inform your instructor before class if you have any injury, medical condition, pregnancy, recent surgery, pain, dizziness, contraindication or anything else that may affect your ability to safely participate. 

By attending our classes, you confirm that you will exercise within your own limits and follow all instructions given by our instructors. 

If you are new or returning to Pilates and/or exercise generally, returning after injury, pregnant, postnatal, or unsure whether a class is suitable, you must inform us before booking or attending. 

We reserve the right to refuse participation, limit participation, or require further information where we reasonably believe this is necessary for your safety or the safety of others. 

Our instructors may provide general guidance relating to movement and exercise, but this does not constitute medical advice. You should consult a medical professional before beginning any new exercise programme. 

10. Liability 

Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. 

Subject to that, and to the fullest extent permitted by law: 

• you participate in classes at your own risk 

• you are responsible for working within your own physical limits 

• we are not responsible for injuries, loss or damage not caused by our negligence. In particular, we are not liable for any injury or harm arising from your failure to obtain medical advice prior to commencingmembership with us, follow instructions, use equipment safely, or disclose relevant health information to us whether on your PAR-Q Form or otherwise 

• we are not liable for loss or damage to personal belongings brought into the studio 

• we are not liable for indirect or consequential loss where such exclusion is lawful 

  • we are not liable to the actions or omissions of other clients 

  • all implied terms relating to quality, fitness for purpose or skill and care are excluded to the fullest extent permitted by law 

Our total liability for any claim arising out of these Terms and Conditions shall not exceed the total amount paid by you in the 12 months preceding the event. 

11. Indemnity 

You agree to indemnify and hold Studio Align harmless from any claims, losses, liabilities, damages, costs or expenses (including legal fees) arising from: 

  • your breach of these Terms and Conditions 

  • your misuse of our equipment or facilities 

  • your failure to follow safety instructions 

  • any claim brought by another client as a result of your actions 

  • any damage you cause to our property or equipment 

12. Under 18s 

Clients under the age of 18 may only attend with valid parent or guardian consent in a form approved by us. 

We reserve the right to request proof of age and to refuse participation where suitable consent has not been provided. 

We may also require under-18 clients to attend only designated classes or induction sessions, if applicable. 

13. Studio Rules 

For the safety and comfort of all clients:

• grip socks must be worn for all reformer classes 

• equipment must only be used as instructed 

• clients must behave respectfully towards staff, instructors and other clients 

• disruptive, unsafe, abusive, discriminatory or inappropriate behaviour may result in removal from class and suspension or termination of your account 

• no alcohol, drugs or smoking are permitted in the studio unless specifically authorised by us in advance in the case of special events 

• phones should be kept on silent during class unless required for an emergency 

You must comply with any additional studio rules, hygiene policies or safety notices displayed in the studio or communicated on our website or booking platform. 

You are responsible for any damage you cause to our equipment, facilities or property (other than fair wear and tear). We may charge your saved payment method for the reasonable cost of repair or replacement. 

14. Pregnancy and Postnatal Attendance 

If you are pregnant or postnatal, you must let us know before attending class. 

Attendance during pregnancy or the postnatal period is subject to instructor approval, any health information you provide, and any medical guidance you have received. 

We reserve the right to restrict attendance to suitable classes or decline participation where we reasonably believe a class is not appropriate. 

15. Photography, Video and Marketing Content 

We may occasionally take photographs or videos in the studio for marketing and promotional purposes. 

We will obtain your explicit consent where you are the main subject of the content. 

Incidental filming or photography may occur in the background of studio content. If you do not wish to appear, please let us know before your class and we will take reasonable steps to respect your preference. 

You must not record, photograph or film any part of a class without our permission. 

If you tag or share content featuring Studio Align on social media, you grant us a non-exclusive, royalty-free licence to repost or share that content for marketing purposes. 

16. CCTV in the Studio 

CCTV operates in the main studio area for security, safety and incident investigation purposes. Footage may capture clients, instructors, staff and visitors. 

CCTV footage is processed in accordance with our Privacy Policy. Access is restricted and footage will only be used, retained or shared where necessary, including for safety, incident investigation, insurance, legal or regulatory purposes. 

17. Marketing Communications 

We may send you service-related communications where necessary in connection with your bookings, account or purchases. 

We will only send marketing communications where you have opted in or where otherwise permitted by law. You may unsubscribe from marketing communications at any time via the link in our emails or by contacting us at info@studioalign.uk

18. Personal Data and Privacy 

We process personal data in accordance with our Privacy Policy. 

Where we collect health information, including via a PAR-Q or similar form, this will be handled with appropriate care and in accordance with applicable data protection law as set out in our Privacy Policy. 

19. Events Outside Our Control 

We are not liable for any delay or failure to provide services where this is caused by events outside our reasonable control, including but not limited to fire, flood, power outage, internet or platform failure, government restrictions, severe weather, staff illness, equipment breakdown, utility interruption or other unforeseen circumstances, and your membership (including charges) will continue during any of these events unless otherwise communicated to you. 

Where possible, we will take reasonable steps to minimise disruption and communicate changes to you. 

20. Transfer of This Agreement 

We may transfer our rights and obligations under these Terms and Conditions to another organisation. If we do so, we will take reasonable steps to ensure that the transfer does not adversely affect your rights. 

21. Changes to these Terms and Conditions

We may update these Terms and Conditions from time to time. 

The latest version will always be available on our website, and any material changes will apply from the date they are published unless otherwise stated. 

22. Severability 

If any provision of these Terms is found by a court or competent authority to be unlawful, invalid or unenforceable, that provision shall be deemed severed and the remainder of the Terms shall remain valid and enforceable. 

23. Waiver 

If we delay or do not exercise any right under these Terms, that does not mean we waive that right. 

24. Governing Law and Jurisdiction 

These Terms are governed by the laws of England and Wales. Any dispute shall be subject to the jurisdiction of the courts of England and Wales unless mandatory consumer law provides otherwise.
